These Terms of Service ("Terms") are a binding agreement between you and Revivify Coatings of America ("Revivify," "we," "us," or "our") governing your access to and use of teamrevivifyusa.com, the applicator portal, the online shop, and related services (collectively, the "Services"). Please read the arbitration provision in Section 13 carefully — it affects how disputes are resolved. By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Services. If you use the Services on behalf of a business (for example, as an applicant or certified applicator), you represent that you are authorized to bind that business to these Terms.
2. The Services
The Services provide information about Revivify products, an installer locator, a warranty-registration system, an application/onboarding path for prospective applicators, and a gated portal and online shop for certified applicators. Revivify products are professional-application only and are sold to and installed by certified applicators — the Services do not sell coatings for self-application by the general public.
3. Accounts
Certain features require an account. You agree to provide accurate information, keep your credentials confidential, and are responsible for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
4. Applicator terms
Certified applicators additionally agree to: (a) complete required Revivify training and certification; (b) apply Revivify products in accordance with brand-trained technique and product directions; (c) register eligible installs for warranty coverage; (d) represent the Revivify brand consistent with our standards; and (e) comply with any separate applicator, distributor, or purchase agreement. Certification and network participation may be modified or revoked for non-compliance.
5. Orders, pricing & payment
Product orders placed through the online shop are available to eligible certified applicators and are processed through our third-party commerce and payment provider (Shopify). Prices, availability, and applicable taxes and shipping are shown at checkout and may change. We may refuse or cancel orders (including for suspected error, fraud, or ineligibility). Refunds and returns, if any, are handled per the policy provided at purchase.
6. Warranty
Coating warranty coverage is described on our warranty page and is subject to the applicable product tier, proper professional installation, timely warranty registration, and the specific warranty terms in effect at registration. The warranty is the sole product warranty offered; nothing on the Services expands it. Except as expressly stated there, products and Services are provided without warranties (see Section 11).
7. Acceptable use
You agree not to: misuse or interfere with the Services; attempt unauthorized access to any system or account; scrape, copy, or harvest data except as expressly permitted; upload unlawful, infringing, or harmful content; misrepresent your identity or certification status; or use the Services to violate any law or third-party right.
8. User submissions
If you submit content (for example, a review, form response, photo, or feedback), you grant Revivify a non-exclusive, worldwide, royalty-free license to use, reproduce, and display it in connection with the Services and our marketing, and you represent that you have the rights to grant that license. We may remove content at our discretion.
9. Intellectual property
The Revivify name, logos, product formulations, training curriculum, site content, and software are owned by Revivify Coatings of America or its licensors and are protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to use the Services for their intended purpose. No other rights are granted.
10. Third-party links & services
The Services may link to or rely on third parties (for example, certified applicators, Shopify, or mapping providers). We are not responsible for third-party content, products, or practices, and your dealings with them are solely between you and the third party.
11. Disclaimers
THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, REVIVIFY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or secure. Coating performance depends on proper professional application, surface conditions, and maintenance; individual results may vary. This section does not limit the express warranty described in Section 6 or any rights that cannot be waived under applicable law.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, REVIVIFY AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUES, ARISING FROM OR RELATED TO THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO REVIVIFY IN THE 12 MONTHS BEFORE THE CLAIM OR US $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
13. Dispute resolution & binding arbitration
Please read this section carefully. It requires disputes to be resolved by individual binding arbitration and waives your right to a jury trial and to participate in a class action.
(a) Informal resolution. Before starting arbitration, you agree to first contact us at info@teamrevivify.com and give us 30 days to resolve the dispute informally.
(b) Binding arbitration. Any dispute arising out of or relating to these Terms or the Services that is not resolved informally will be settled by final and binding arbitration administered by a recognized arbitration provider (such as the American Arbitration Association) under its consumer rules, before a single arbitrator, in or near Orange County, California, or by telephone/video where available. The Federal Arbitration Act governs the interpretation and enforcement of this section.
(c) Class-action waiver. Disputes will be arbitrated only on an individual basis. You and Revivify waive any right to bring or participate in a class, collective, consolidated, or representative action. The arbitrator may not consolidate claims or preside over any form of representative proceeding.
(d) Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court to protect intellectual-property rights.
(e) 30-day opt-out. You may opt out of this arbitration agreement by emailing info@teamrevivify.com with the subject "Arbitration Opt-Out" within 30 days of first accepting these Terms. Opting out will not affect any other part of these Terms.
14. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Subject to Section 13, the exclusive venue for any permitted court action is the state and federal courts located in Orange County, California, and you consent to their jurisdiction.
15. Indemnification
You agree to indemnify and hold Revivify harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your content, or your violation of these Terms or any law or third-party right.
16. Changes to the Services or Terms
We may modify or discontinue the Services at any time. We may update these Terms by posting a revised version with a new "Last updated" date; material changes will be communicated where required. Your continued use after changes take effect constitutes acceptance.
17. Text messaging (SMS) program
By providing your mobile phone number and checking a consent box on one of our forms, you agree to receive text messages from Revivify at that number, including messages sent using an automatic telephone dialing system. Consent is not a condition of any purchase, is not required to submit a form, and is not required to receive a response from us.
Program description. We operate two separate opt-ins, and you may accept either, both, or neither. Transactional and informational messages relate to your inquiry, appointment and account updates, and applicator program status. Promotional and marketing messages cover offers, product news and events. Promotional messages are sent only to those who checked the separate promotional consent box.
Message frequency. You will receive up to 4 messages per month.
Cost. Message and data rates may apply depending on your mobile phone service plan. Revivify does not charge for the messages themselves.
Help and cancellation. Reply HELP at any time for help, or contact us at info@teamrevivify.com or (800) 940-8033. Reply STOP at any time to cancel. After you reply STOP, we will send one confirmation message and then stop sending you text messages. You may re-join at any time by submitting a new opt-in.
Carriers. Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your carrier and is not guaranteed.
Your information. Mobile information is handled as described in our Privacy Policy. No mobile information will be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.
18. Termination
We may suspend or terminate your access to the Services at any time for any reason, including violation of these Terms. Sections that by their nature should survive termination (including Sections 8–15) will survive.
19. Miscellaneous
These Terms, together with any policy or agreement referenced here, are the entire agreement between you and Revivify regarding the Services. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them.
